Position Overview
We are seeking a Remote BIA Appeals Attorney with substantial experience in immigration law and a passion for appellate advocacy. The ideal candidate will bring strong analytical and writing skills to support clients through complex immigration appeals before the Board of Immigration Appeals (BIA). This position is ideal for a motivated, detail-oriented legal professional who wants to make a real impact—while enjoying the flexibility of remote work or an optional in-office setting.
Key Responsibilities
Draft and file appellate briefs, motions to reopen, motions to reconsider, and other filings before the BIA.
Analyze case files, immigration court transcripts, and rulings to identify legal errors and build compelling appellate arguments.
Conduct thorough legal research on immigration statutes, precedent decisions, and current case law.
Work closely with trial attorneys and legal staff to develop and execute appellate strategy.
Communicate effectively with clients to gather information, explain legal options, and provide case updates.
Keep up to date with changes in immigration law and policy at the BIA, EOIR, USCIS, and federal appellate courts.
Maintain strict adherence to deadlines and professional standards.
Qualifications
Required:
J.D. from an accredited law school
Active license to practice law in any U.S. jurisdiction
Minimum 3 years of experience in immigration law, with at least 1 year handling BIA appeals
Superior legal writing, research, and analytical skills
Strong time-management and organizational skills
Proficiency in legal research platforms (e.g., Westlaw, LexisNexis) and case management systems
Preferred:
Experience with federal immigration litigation, including petitions for review in federal circuit courts
Previous experience working in a remote legal environment
